Welcome to My Dream Monsters. These Terms of Service ("Terms") govern your use of MyDreamMonsters.com and the related services we provide (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 18 years old to register a parent account. Children under 18 may use the Service only through a child profile created and supervised by a parent or legal guardian who has agreed to these Terms on the child's behalf.

2. Accounts and supervision

  • The parent is responsible for everything done under their account and any associated child profiles, including artwork uploads, payments, and sharing.
  • You agree to provide accurate registration information and to keep your password confidential.
  • You may not create an account on someone else's behalf without their authorization, and you may not impersonate any person.

3. Acceptable content

The Service is for original, child-friendly monster artwork. You agree not to upload:

  • Sexual, hateful, violent, frightening, or otherwise inappropriate content for a children's platform.
  • Content that infringes anyone else's copyright, trademark, or other rights.
  • Photos of real people, personal contact information, or anything that could identify a child to strangers.
  • Malware, spam, or attempts to disrupt the Service.

Every artwork upload is reviewed by an admin. We may reject or remove any submission at our sole discretion if it violates these Terms or our community standards. Repeated violations may result in account suspension or termination.

4. Your content

You and your child retain all ownership rights to artwork uploaded to the Service. By uploading, you grant us a worldwide, royalty-free, non-exclusive license to host, display, resize, and (for public artwork) include the work in moderated galleries on the Service. For artwork marked private, the license is limited to displaying the work to recipients explicitly invited by the parent.

We will not sell your child's artwork or use it in advertising without your express written permission.

5. Upload tokens and payments

  • Each child account starts with three free upload tokens. After those are used, additional tokens may be purchased by the parent.
  • Tokens are consumed permanently when an artwork is submitted, even if the artwork is later deleted or rejected.
  • Token purchases are final and non-refundable except where required by law. If you believe a charge was made in error, contact us at support@mydreammonsters.com.
  • Payments are processed by Stripe under Stripe's own terms. We do not store full card numbers.
  • Tokens have no cash value, cannot be transferred between accounts, and do not expire.

6. Privacy and sharing

Our handling of personal information is described in our Privacy Policy. Parents control whether each piece of artwork is private or public. By using the public gallery, you acknowledge that approved artwork may be visible to anyone on the internet.

7. Account suspension and termination

You may close your account at any time from the parent dashboard or by contacting support. We may suspend or terminate accounts that violate these Terms, abuse moderation tools, or attempt to circumvent safety features. Where possible, we will give notice and an opportunity to fix the issue before suspending an account.

8. Disclaimers

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or that any specific artwork will be approved. To the fullest extent permitted by law, we disclaim all implied warranties.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify the parent's registered email address and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Wisconsin, unless required otherwise by applicable consumer-protection law.
